If you are a victim of sexual assault or domestic violence, the Santa Cruz Police Department is here to help. Our department is here to serve you in a caring and confidential manner. Please contact us immediately if you are a victim of sexual assault or domestic violence, our agency will work on your behalf during this difficult process to ensure you receive the proper assistance.

SEXUAL ASSAULT
A person commits a sexual assault when they intentionally or knowingly do any of the following to another and it is committed against that person's will:

  • Causes the sexual organ of another person to contact or penetrate the mouth, anus, or sexual organ of another person, including the suspect.
  • Touching of the breast, buttock, or genital area of a person without their consent.
  • Penetration of another person by any means.

If you are a victim of a sexual assault, you should: Call 911.

  • Attempt to recall as much as possible about the attacker.
  • Preserve all physical evidence.
  • Do not take a bath, shower, douche, wash, or change clothes and/or linens.
  • Do not touch anything handled by the attacker.


You may need a medical examination. The examination will be paid for by the Police Department if the victim files a police report.

Be sure to take clean clothing to wear after the examination. Clothing worn during the attack will be turned over to the police for laboratory analysis.

  • When the police officers arrive they will ask you if you need medical attention.
  • They will look for evidence and fill out a report. A suspect will be arrested if it is possible.

A specialized sexual assault response team (S.A.R.T.) may be called in to assist the victim. The response team will also include a victim advocate.  The report will be sent to the Police Investigations Section for further investigation.

 

Domestic Violence
Domestic violence is abuse committed against an adult or fully emancipated minor who is a spouse, former spouse, cohabitant, former cohabitant or a person with whom the suspect has had a child or has had a dating or engagement relationship.
Domestic Violence needs to be reported!

Call 911 in an emergency.

If you are the victim and fear for your safety, you have the right to ask the responding officer for an Emergency Protective Order (E.P.O.) if the violence occurs in the evening or on weekends when the court is closed. The E.P.O. is valid for five (5) court days, allowing the plaintiff time to get a temporary restraining order. Because of state law, if a police officer witnesses injuries on a victim in any domestic violence case, the officer must make an arrest of the suspect, with or without the victim's desire for an arrest to be made.

El Asalto Sexual
La violación o asalto sexual es un crimen contra Ud. Se merece ayuda si alguien le ha asaltado sexualmente. Sea cometido por un desconocido, un novio, un amante, su esposo, un compañero doméstico, o un conocido, puede llamar al 911y denunciarlo a la policía. En el Condado de Santa Cruz, hay un programa en el cual enfermeras examinan heridas físicas y obtienen evidencia del crimen que queda en su cuerpo. Esta evidencia sirve para un posible juzgamento criminal contra el violador. Aunque decida no denunciarlo Ud. puede llamar a una línea de crisis para obtener apoyo y más información.

Violencia Doméstica
La violencia doméstica puede ocurrir entre personas de cualquier orientación sexual, sean casados,separados, novios, los que han sido novios, compañeros domésticos, los que hanvivido juntos o los que tienen hijos juntos. Es un crimen si alguien le golpea o le hace daño.

Lo que necesita saber
Aún cuando detienen al sospechoso, lo pueden soltar de la carcel a cualquier hora. Si piensa que el sospechoso volverá a hacerle daño a Ud. o a su familia, pregúntele al policía sobre una Orden de Protección de Emergencia. Esta orden obliga al sospechoso ausentarse por cinco dias. El policia también puede proteger su nombre del registro público por ejemplo, en el periódico.
Para más información sobre los refugios para mujeres maltratadas, como presentar una Orden de Restriccióáán o otros servicios en la comunidad, llame a Women's Crisis Support (Apoyo Para Mujeres en Crisis) o Defensa de Mujeres. Una orden puede mandar al sospechoso fuera de la casa y limitar contacto con su lugar de trabajo, su casa y su escuela. También puede determinar custodia, apoyo monetario para los hijos, pago de deudas, y consejeria. Ud. tiene el derecho de pedir una orden que restringe al sospechoso de hacerle daño o hacer daño a su familia.
Si Ud. quiere denunciar a un abusador o violador, tiene que hablar con el fiscal del distrito judicial y los Servicios para Victimas. También tiene el derecho a preparar un juicio civil contra el abusador o violador para recompensar los daños y perjucios a causa del abuso.
